One person was killed and another severely injured as the result of a major accident on Cortez Road West in Manatee County on the afternoon of Monday, October 14.
According to the Florida Highway Patrol, the accident occurred at approximately 4:11 p.m. at the intersection of Cortez and Independence Drive. The driver responsible was an 87-year-old man in a Buick Lucerne, who stopped at a stop sign on Cortez then attempted to make a left turn. In doing so, he entered the path of a Dodge Ram that was heading east on Cortez. The left side of Buick collided with the front of the pickup, which continued traveling, overturned and finally came to rest in a turn lane.
The man died as a result of his injuries, and his 80-year-old female passenger was reported as being in critical condition at Blake Medical Center. The 44-year-old male driver of the pickup sustained minor injuries.
Passengers can file claims against drivers
In a case in which a passenger was injured as a result of the negligence of the driver of the vehicle they were in, that passenger has the right to file a personal injury claim against the driver just as they would if they were a driver or passenger in another vehicle. The claim would proceed in the exact same way.
If the negligent party passes away in the accident, the victims can still file a claim against the negligent party’s estate.
