Hyundai Puts the Brake on its Genesis Vehicle That Does Not Brake

Hyundai is recalling 27,500 Genesis luxury cars from the years 2009 through 2012 following an investigation by the National Highway Traffic Safety Administration (NHTSA). The affected models were found to have problems with their brakes as a result of gel collecting on the braking system valves because the car’s fluid lacked a corrosion inhibitor. Most of the models recalled have already been repaired and the company will offer remaining owners a loaner car while the repairs are made. The problem was first discovered after Hyundai received 23 complaints from drivers whose brakes required extra pressure or failed completely.

Accidents caused by faulty brakes

In a rear-ender, fault almost always lies with the driver in the rear who is responsible for traveling at a safe distance from the vehicle in front. One exception is when the rear vehicle’s brakes suddenly fail, preventing the driver from safely bringing the vehicle to a stop to avoid an accident. Faulty brakes are responsible for many traffic accidents causing serious injuries and deaths. However, a driver will not be excused by just claiming brake failure. Rather, the claim will have to be supported by evidence such as:

  • A neutral mechanic confirming the brake failure immediately following the accident
  • The driver reporting the brake failure to the police at the scene of the accident
  • The claim not being disputed by witnesses to the accident
  • The brake failure was a sudden and unexpected emergency and not a result of the owner’s failure to maintain and repair their vehicle

When a sudden brake failure is found to be the cause of an accident, those injured as a result can seek compensation from additional parties including the manufacturer of the vehicle itself and the manufacturer of the braking system, as well as the mechanic who last installed the brakes.

If you were injured as a result of faulty brakes in your car or another vehicle you may be entitled to monetary compensation. A skilled and experienced Florida personal injury law firm specializing in car accident cases can help you get it.
