Controversy Sounds Traffic Cameras — But Can They Help Your Case?

Red light cameras have been subject to legal controversy, mostly over ticketing and studies showing that traffic cameras increase rather than decrease intersection accidents. Various judges have questioned the constitutionality of red light camera citations and found them to violate due process rights.

The Miami Herald recently reported that the state legislature hit a dead end on prohibiting more installations of cameras, and House and Senate representatives are at odds with each other in resolving the issue.

Putting politics aside, what are the dangers of being involved in an accident where the other driver runs the red light? A comprehensive report released in 2008 about red light running that caused Florida accidents and injuries noted the following:

  • From 1998 to 2006, red light running did not increase traffic fatalities, which average 110 per year due to red light violations
  • Four percent of Florida's estimated 3,000 traffic fatalities are due to red light violations
  • Injuries caused by red light violations reduced by one third from 1998 to 2006

Can traffic camera evidence help your accident case?

An Orlando resident certainly thought so when telling her story in a letter to the editor of the Orlando Sentinel. She described a car crash where the other vehicle hit her driver's side, spinning her car around into a neighborhood yard. As she climbed over the center console to get out of her car, the other driver started accusing her of running the red light and dropped to the ground crying in pain while bystanders watched.

Several days later while struggling with her own injuries, she received notice of a lawsuit brought by the other driver's attorney. However, the same day the city of Orlando's video installed at the intersection where their accident occurred revealed important evidence. It showed the light was red for several seconds before the other driver's car entered the intersection. The other driver was at fault.

When dealing with a serious car accident, put an experienced Sarasota County accident lawyer on your side and protect your rights.
