An employee of the Bradenton Public Works and Utilities Department was the victim of a fatal accident on Tuesday, March 17.
According to reports, the accident involved a front-end loading garbage truck on Sandpiper Circle in the Perico Bay Club on Perico Island, located in West Bradenton. The worker had been with the city for many years.
There was not any immediate information about the cause of the accident or the identity of the deceased.
Families can file wrongful death or workers’ comp cases after fatal workplace accidents
A person who passes away from injuries suffered in the workplace will obviously be unable to take legal action to recover compensation. However, their families do have the ability to take legal action on their behalf. Depending on the circumstances of the accident, the most likely options will be either filing a wrongful death claim or a workers’ compensation claim.
Wrongful death claims are only an option if the plaintiff is able to prove fault on the part of a defendant, like the employer or a manufacturer of a piece of malfunctioning equipment. Otherwise, if there is no element of fault in the case and the accident was simply that—an accident—then workers’ compensation is going to be the most likely way you’ll be able to recover compensation.
